Welcome to HomeSketch ("the App"). By using this App, you agree to the following Terms & Conditions. If you do not agree, please do not use the App. This agreement is entered into between you and the HomeSketch developer only, and not with Apple, Inc. The developer — not Apple — is solely responsible for the App and its content.

1. Use of the App
HomeSketch is an AI-powered home styling application intended for personal, non-commercial use. It allows users to upload photos of their living spaces and receive AI-generated interior design suggestions.

2. User Content
By uploading photos or images to HomeSketch, you confirm that you have the right to share those images. You retain ownership of your original photos. However, you grant HomeSketch and its service providers (including Replicate) a limited, non-exclusive license to process those images solely for the purpose of generating design output within the App.

3. AI-Generated Designs
Design outputs generated by the App are produced by third-party AI models via Replicate's API. HomeSketch does not guarantee the uniqueness, accuracy, or fitness of any generated design for a particular purpose. You may use generated designs for personal use; commercial redistribution is not permitted without prior consent.

4. Intellectual Property
The App's interface, branding, original assets, and non-AI-generated content are the intellectual property of the developer. Third-party AI models used within the App are the property of their respective owners.

5. In-App Purchases
HomeSketch offers premium features via auto-renewable subscriptions and in-app purchases processed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID account settings. All purchases are final and subject to Apple's refund policy. We do not store your payment details. Apple has no obligation to provide refunds or billing support on our behalf.

6. Third-Party Services
HomeSketch integrates with:

• Replicate — for AI image generation (your uploaded images are processed on their infrastructure)

• Supabase — for anonymous authentication and session management

We are not responsible for service interruptions, output quality, or data handling practices beyond what is disclosed in this policy.

You acknowledge that Apple has no obligation whatsoever to provide any maintenance or support services with respect to HomeSketch. Any support inquiries should be directed to the developer, not Apple.

7. No Warranty
HomeSketch is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, specific design quality, or that generated outputs will meet your expectations.

8. Limitation of Liability
We are not liable for any direct or indirect damages resulting from use of the App, including loss of images, unsatisfactory AI outputs, or third-party service failures.

9. Changes to Terms
We may update these terms at any time. Continued use of the App after changes are posted constitutes acceptance of the updated terms.

10.Product Claims
The developer, not Apple, is responsible for addressing any claims by you or any third party relating to HomeSketch or your use of it. This includes, but is not limited to: product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar laws.

11. Legal Compliance
By downloading or using HomeSketch, you represent and warrant that: (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.

12. Third-Party Beneficiary
You acknowledge and agree that Apple, Inc. and its subsidiaries are third-party beneficiaries of these Terms & Conditions. Upon your acceptance of these terms, Apple will have the right — and will be deemed to have accepted the right — to enforce these Terms & Conditions against you as a third-party beneficiary thereof.
